These Terms & Conditions apply to purchases made through the EVOX online store. Please review the information below before placing an order.

Scope & Contracting Party

These Terms & Conditions apply to all contracts concluded through the EVOX online store between EVOX and consumers.

A consumer within the meaning of these Terms & Conditions is any natural person who enters into a legal transaction predominantly for purposes that cannot be attributed to their commercial or independent professional activity.

Sales through the EVOX online store are made exclusively to consumers.

Products & Compatibility

EVOX offers handcrafted motorcycle components and related products designed for selected motorcycle models.

The essential characteristics, compatibility information, materials, available variants and other relevant details are described on the respective product page.

Due to the handcrafted production process and the visual characteristics of materials such as carbon fibre, minor variations in weave pattern, surface structure, colour tone or appearance may occur between individual products.

Such minor visual variations are characteristic of handcrafted components and do not constitute a defect where the agreed quality, functionality and intended use of the product are not impaired.

Product photographs are intended to represent the products as accurately as possible. Colours and surface appearance may vary slightly depending on lighting conditions, photography and the customer's display settings.

Customers must select the product version intended for their specific motorcycle model, model year and configuration based on the compatibility information provided on the relevant product page.

Orders, Contract & Payment

The presentation of products in the EVOX online store does not constitute a legally binding offer by EVOX. It is an invitation to the customer to submit an order.

By completing the checkout process and clicking the button that clearly indicates an obligation to pay, the customer submits a binding offer to purchase the products contained in the order.

After the order has been submitted, EVOX may send an automated email confirming receipt of the order. This acknowledgement of receipt does not, by itself, constitute acceptance of the customer's offer.

The purchase contract is concluded when EVOX expressly accepts the order by sending an order confirmation or when EVOX dispatches the ordered goods, whichever occurs first.

Before a contract has been concluded, EVOX may decline an order if a product cannot be manufactured or supplied, if the selected product is incompatible with the information provided, or if an obvious pricing or technical error has occurred.

The payment methods available for the respective order are displayed during checkout. Depending on availability, these may include PayPal, credit card and other payment methods provided through the payment services integrated into the EVOX online store.

If payment has already been collected and EVOX subsequently does not accept the order, the amount collected will be refunded without undue delay.

Production, Shipping & Delivery

Most EVOX products are manufactured or finished only after an order has been placed.

The fact that a standard EVOX product is manufactured after an order is placed does not, by itself, mean that the product is individually customised.

Production time depends on the respective component and the current production workload. The manufacture of an individual component may require up to approximately 14 calendar days once production of that component has begun. Additional lead time may arise where previously confirmed orders are already in the production queue.

The estimated production and/or dispatch time stated on the respective product page or during the ordering process takes precedence over general estimates contained in these Terms & Conditions.

If an unforeseen delay occurs after the contract has been concluded, EVOX will inform the customer without undue delay and provide an updated estimated dispatch or delivery date. Statutory rights in the event of delayed performance remain unaffected.

Available delivery destinations, shipping methods and shipping costs are displayed on the website and/or during checkout. Further information is available on the Shipping page.

For deliveries outside the European Union, customs duties, import taxes or similar charges may be imposed by the destination country. Where applicable, such charges are generally not included in the EVOX purchase price and may be payable by the customer.

Right of Withdrawal & Bespoke Products

Consumers may have a statutory right of withdrawal in accordance with applicable law.

Detailed information concerning the conditions, period, procedure and consequences of exercising the right of withdrawal is provided on the Right of Withdrawal page.

Where applicable, customers may also use the electronic Withdraw from Contract function available on the EVOX website.

Customers are not required to provide a reason when exercising a statutory right of withdrawal.

Customers may contact EVOX to request a product manufactured according to specifications that are not part of the standard product options offered through the online store.

Such bespoke requests may require an individual agreement concerning specifications, price and production time.

Where a product is not prefabricated and is manufactured on the basis of an individual customer selection or specification that is decisive for its production, or is clearly tailored to the customer's personal requirements, the statutory right of withdrawal may be excluded to the extent permitted by applicable law.

Where such an exclusion applies, EVOX will inform the customer accordingly before the relevant contract is concluded.

A standard EVOX product is not considered a bespoke product solely because EVOX begins manufacturing it after receiving an order.

Returns, Defects & Warranty

Information concerning the practical procedure for arranging a return is provided on the Returns page.

The EVOX return procedure is intended to facilitate the handling of returns and does not restrict statutory rights relating to withdrawal, defective goods or other consumer rights.

The customer's statutory rights in respect of defective goods remain unaffected.

If a product is delivered damaged, defective or different from the product ordered, the customer may contact EVOX so that the matter can be reviewed and resolved.

Failure to contact EVOX immediately after discovering a defect does not, by itself, result in the loss of statutory consumer rights.

Any voluntary manufacturer's or commercial warranty offered in relation to a product exists in addition to statutory consumer rights and does not restrict them.

Product Use & Liability

EVOX products must be installed and used in accordance with the applicable specifications and instructions of the motorcycle manufacturer as well as any information supplied with the EVOX product.

Customers should verify that the selected product is intended for their specific motorcycle model, model year and configuration.

Improper installation, unauthorised modification or use contrary to applicable manufacturer specifications may affect the function or safety of the product or motorcycle.

EVOX is liable without limitation for damage caused intentionally or through gross negligence.

EVOX is also liable without limitation for damage resulting from injury to life, body or health where EVOX is legally responsible, as well as in cases where liability is mandatory under applicable law.

In cases of simple negligence involving the breach of an essential contractual obligation, liability is limited, to the extent legally permissible, to damage that was foreseeable and typical for this type of contract.

Mandatory statutory consumer rights remain unaffected.

Intellectual Property

Unless otherwise stated, trademarks, logos, product photographs, graphics, texts, designs and other content made available through the EVOX website are owned by EVOX or used with permission of the respective rights holder.

Such content may not be reproduced, distributed, modified or commercially exploited without permission of the respective rights holder except where such use is permitted by law.

Nothing in this section restricts rights granted to users under mandatory applicable law.

Governing Law & Final Provisions

The laws of the Federal Republic of Germany apply to contracts between EVOX and the customer.

Where the customer is a consumer whose habitual residence is in another country, this choice of law does not deprive the customer of the protection afforded by mandatory provisions of law that would apply without this choice of law.

EVOX may amend these Terms & Conditions for future transactions. Changes do not retroactively alter contracts that have already been concluded.

The version of these Terms & Conditions applicable at the time of the customer's order applies to that order.

If an individual provision of these Terms & Conditions is or becomes invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law. Mandatory statutory provisions apply where required.
